Know Your Bankruptcy Terms: Credit Counseling

San Diego Bankruptcy Lawyer – in the bankruptcy setting credit counseling comes up in two situations: the one before filing Chapter 7 or Chapter 13 and the instructional one the court requires before issuing the discharge.  As with everything in the bankruptcy law, there are exceptions to these requirements but as a rule of the thumb, they are required when filing.
Before filing for, your San Diego lawyer can give you the name of an approved credit counseling organization that will discuss your financial situation.  If you cannot afford to pay for your certificate the organization must provide it to you for free.  If you can, it will generally be around $50.00.  All fees must be disclosed prior to the session.
After the session, make sure you get your certificate that proves you completed the course.  You will have to provide this to your San Diego bankruptcy lawyer before filing Chapter 7 or Chapter 13.  Your lawyer in turn will provide it to the Court.
The second session is more of an education course.  After filing in San Diego, the courts want to make sure that you have all the information necessary to have a successful financial future.  Make sure your provider is approved by the bankruptcy court.  Check their website for the approved list.  Again, you want to get the certificate as proof and give it to your lawyer.
